BREAKING: Gov. Mutfwang Reinstated as Plateau State Leader by Supreme Court! Court Overturns Controversial Decision, Upholding Mutfwang’s 2023 Election Victory!

Abuja, Nigeria: In a shocking turn of events, the Supreme Court of Nigeria has overturned the Court of Appeal’s earlier ruling and reinstated Governor Caleb Mutfwang of Plateau State as the rightful leader. This dramatic move follows months of uncertainty surrounding the 2023 gubernatorial election, with various legal challenges clouding the political landscape.

The apex court, in a unanimous decision, declared the Court of Appeal’s judgment “a fundamental error” and reinstated Mutfwang, who stood as the candidate for the Peoples Democratic Party (PDP), back to his rightful position. This comes as a major blow to Nentawe Goshwe, the All Progressives Congress (APC) candidate who was previously declared the winner by the appellate court.

The Supreme Court’s decision rests on two key points:

  1. Nomination Challenge Time Limit: The court ruled that the APC and Goshwe lacked the “locus standi” – the legal standing – to challenge Mutfwang’s nomination. According to the Electoral Act 2022, only PDP members who participated in the party’s primary election have the right to contest its outcome in court. The APC’s challenge, therefore, falls outside the legal realm.
  2. Jurisdictional Error: The Supreme Court deemed the Court of Appeal’s handling of the case a crucial error. They upheld that the appellate court lacked the jurisdiction to determine the validity of Mutfwang’s primary election, further emphasizing that the validity of his nomination cannot be contested at an election petition tribunal.

Justice Emmanuel Agim, who delivered the lead judgment, went on to express strong concern about the Court of Appeal’s decision, stating that it could “render the legal profession irrelevant” if such rulings become commonplace. This strong message underlines the court’s emphasis on legal propriety and adherence to established procedures.

What This Means for Plateau State:

Governor Mutfwang’s reinstatement marks a significant development for Plateau State. The months of legal limbo and political uncertainty can finally come to an end, allowing the state to focus on addressing pressing issues and moving forward with a stable leadership. While some reactions might be mixed, the Supreme Court’s decision upholds the democratic process and ensures that the duly elected representative resumes his rightful place in government.

The self-acclaimed ‘richest girl in Nigeria’shared a little controversial note with his 4 million Instagram followers. In the now-deleted post, Bobrisky noted that only those who are desperately searching for husbands put up quotes weekly.

He also went on to solicit on behalf of the IG community as he urged this individual to stop while insisting that everyone is fed up with the quotes flying in every now and then.

In a follow-up post, which was also deleted few minutes after he shared it, he added that when people suffer from a relationship crisis (chop breakfast), they drastically turn to motivational speakers.

Sen JT Useni Wins Big at the Plateau Governorship Election Petition Tribunal, Jos



The Tribunal today agreed with the Counsel to Sen JT Useni that a witness whose statement on oath has already been front loaded in a Petition but not listed can be allowed to testify at the Tribunal.

The Tribunal therefore overruled the objections by counsel to INEC, Lalong and APC which sought to stop a PDP witness,
Baba Ali Adam, whose name had carried an acronym “AAQ” from testifying.

They had based their objections on Paragraph 4 (5) of the First Schedule of the Electoral Act which provides that an Election Petition shall be accompanied by a list of witnesses among other things.

But Useni’s Counsel had countered, describing the objection as a gross misconception of the Electoral Act which gave the tribunal all directions on all matters concerning witnesses.
The Tribunal, in a ruling read by the Chairman,
Hon Justice HA Saleeman, agreed with the position of the Petitioners’ counsel. The Tribunal relied on Paragraph 53 (1) of the First Schedule of the Electoral Act which provides that non-compliance with the rule of practice shall not render any proceeding void unless the tribunal so directs.

The Chairman equally cited other authorities, and therefore refused the objections of the Respondents’ counsel and ordered that the witness Baba Ali Adam, aka ‘AAQ’ should proceed to give his testimony.



She said there is need to do substantial justice to the petition before the tribunal.
Meantime, the tribunal has reserved ruling on another objection by the Respondents’ counsel seeking to stop the same witness from testifying on INEC Form EC8A (Statement of Results) saying he did not refer to the form in his deposition.

However, the tribunal agreed with the position of Counsel to Sen Useni, Barr EG Pwajok, SAN, that stopping the witness at this point will deny the Petitioners “substantial justice” . Hon Justice Saleeman therefore reserved ruling until at the final judgement.

These landmark rulings clear the way for Sen Useni and the PDP to bring in their witnesses and so meet up with the time limit set for the tribunal to complete its assignment.

Court Releases Final Judgement In PDP’s Favour



It has been reported that the Governorship Election Petition Tribunal sitting in Enugu on Monday struck out the petition

challenging the victory of Gov. Ifeanyi Ugwuanyi as the winner of the March 9 governorship election in the state.



The petition was reportedly filed by Action Peoples Party (APP) The tribunal, chaired by Justice I. M. Sambo, struck out the

petition after entertaining a motion on notice for the withdrawal of the petition. Counsel to the petitioner/applicant, Mr Obed

Agu, told the tribunal that the petitioner had resolved to discontinue with the process as filed. He prayed the tribunal to strike

out the petition, pursuant to Rule 29, Rules of Procedure of Election Petitions.



“The petitioner filed a notice of withdrawal of the petition before the tribunal. We, therefore, seek the order of the tribunal

granting leave to the petitioner/applicant to withdraw the petition in its entirety, and consequential order striking out the

petition,” Agu said.



In her submission, Mrs A.J. Offiah (SAN), counsel to the governor and first respondent, said that they had entered appearance

after being served with the petition. “We concede that we were served with an application for the withdrawal and dismissal of the

petition,” she said.



Offiah said that they had filed and served the petitioner/applicant, an affidavit against illegal terms of withdrawal, adding that

they were not opposed to the application. The tribunal consequently dismissed and struck out the petition and awarded no cost

to the respondents.



The News Agency of Nigeria (NAN) reports that other counsels present during the sitting are counsels to Peoples Democratic

Party (PDP) and Independent National Electoral Commission (INEC) Chief A. I. Ani and Mr Humphrey Okoli respectively.



Recall that it has been reported that a  Federal High court sitting in Abuja has struck out the suit filed by Peoples Democratic

Party (PDP)  against APC. The suit was filed by a senatorial candidate of the Peoples Democratic Party (PDP) in Bauchi state,

Garba Dahiru.  Dahiru had asked the court to declare him the winner of the election in Bauchi South Senatorial District and issue

him the  certificate of return as the All Progressives Congress (APC) which polled the most votes in the election did not have a

candidate.



The APC had failed to provide a candidate as there was confusion in the party over who is the authentic candidate for the Bauchi

South senatorial poll is. The Independent National Electoral Commission (INEC) decided to declare the APC the winner of the

election. Results of the February 23 election as announced by INEC showed that the APC garnered 250,725 votes, while Dahiru

scored 175,527 votes. Returning Officer, Ahmed Sarkin-Fagam, said he could not declare a winner for the election because APC

had no candidate recognised by the law. as it had failed to substitute its candidate, Lawal Gumau, as directed earlier by a federal

high court.



The judge at the federal high court in Abuja, Taiwo Taiwo, in his ruling on Wednesday, held that it is a post-election matter and

that the court lacked jurisdiction to entertain it. He added that the appropriate court for the matter is the election petition

tribunal. Taiwo said the court could not decide on the candidacy of the APC since it is already a subject before the appellate court.



He added that doing so would merely amount to an academic exercise. Addressing journalists shortly after the judgment, the

INEC lawyer, Alhassan Umar, thanked the court for a well-considered judgement, while Prisca Elesike, who is counsel to Mr

Dahiru, said: “an appeal is a better option.”

The friends of a Delta State Polytechnic student, identified as Glory Emioma, have all taken to social media to pay their tribute to her after news of her death.

According to Glory’s friends, she was stabbed to death while struggling with a phone snatcher. One of her friends, Youngy Bui wrote,

was still on, Kemi Olunloyo, the controversial
daughter of the former governor of Oyo State,
claimed a ritualist she interviewed told her that
Olamide sacrificed his recently deceased father,
for fame and fortune.
Fast forward to this morning, she took to her
social media platforms to announce that she
suffered a severe head injury last night and she’s
going to be hospitalized for a month or more.
She asked people to pray for her but was mocked
instead.

Reekado banks eventually won the award and YBNL boss Olamide took to the stage to air his frustration as he believes label mate Lil kesh had a stellar year ans so deserves the award.

ENV NEWS: Expect Hell If Kanu Dies In Detention – Aka Ikenga



An Igbo group, Aka Ikenga has warned the federal government that mayhem would be unleashed if Nnamdi Kanu passes away in detention,
Daily Independent reports.
The director of Radio Biafra was arrested by operatives of the Department of State

Service (DSS) and his continued
detention has resulted in several
protests in some parts of the country.

The protesters have also been agitating for an independent Biafra state.

Goddy Uwazurike, the president of the group said on Wednesday, December 30 in Lagos that since a competent court had ordered his release, the government should comply.

He berated the government for
tampering with the rule of law and warned of serious consequence if Kanu dies in prison.

He said: “It is executive lawlessness to detain a man who has been unconditionally released by the court of competent jurisdiction.
That is what the law says.

That is why the judiciary is there” “The rule of law is a cardinal part of our democracy so when the court gives judgment, everyone obeys.
It is not for the government to prosecute and adjudicate at the same time.
To continue to detain a man after he has been freed is nothing but executive brigandage.
        “Of course,
the federal government is asking for something bigger than what is happening now if anything untoward should happen to Kanu while in detention. What is right is right, what is wrong is wrong. It is wrong to keep a man in detention after he has been freed
by the court.
     “If anything happens to him, then the bear hundred percent liability for it. If you have no right to do what you are doing and you continue to do it, then
they should face whatever they see”.
 “They arrested him and took him to court. Having submitted to the jurisdiction of the court, why then are you treating the court as if they don’t exist?

If you don’t want the judiciary to
exist, why don’t you go ahead and amend the constitution and delist the judiciary?. Then you also delist the legislature and we will all know that we have a full military government.”

NYSC: 45 Corps Members In Lagos To Repeat Service @easynetvibe



The Coordinator, National Youth
Service Corps, NYSC, Lagos State, Mr.
Cyril Akhanameh yesterday, said 45
corps members, who absconded
during their service year will repeat
the service.
He said: “45 corps members will
repeat their service year due to
physical absence from their places of
primary assignments.”
According to him, ”’Many of the corps
members left their places of primary
assignments for over three months
without permission, adding that
when queried, they could not give
any genuine reason for being absent.”
“The level of their punishments, he
noted, will be determined by the level
of their offences, stating that many of
them will repeat, serve for three or
four months in any part of the states
that NYSC Authorities will choose,”
Vanguard reports.
